Terms and Conditions

Thank you for enrolling in MetamoRPh Review Specialist, Inc.

Please read these Terms and Conditions set forth by MetamoRPh Review Specialist, Inc carefully before completing a transaction and using the www.metamorph.ph website.

1. Section 1. General Provisions
   1. MetamoRPh provides review programs for pharmacy licensure exams and continuing professional development programs. By enrolling, the subscriber agrees to these Terms.
   2. Non-acceptance of any provision of these Terms and Conditions shall preclude the enrollee from accessing or using any of MetamoRPh Review Specialist, Inc.'s services, whether online or onsite.
2. Section 2. Modification of Services
   1. MetamoRPh Review Specialist, Inc reserves the right to modify, when the need arises, the conduct of a program or service, including the schedules, set of lecturers, and facilities with the intention of providing better services.
   2. MetamoRPh Review Specialist, Inc may change the prices of its services and update these Terms and Conditions on our website, forms, and other platforms from time to time. The changes are final and executory.
3. Section 3. Payments and Transactions
   1. Location and Price: MetamoRPh Review Specialist, Inc is a Philippine-based company and offers services that cater to aspiring pharmacists both locally and internationally. The prices of our products and services are listed on our website and social media platforms. They are listed in Philippine Peso (Php).
   2. Payment Services: When payments for any product or service is required, MetamoRPh Review Specialist, Inc uses Direct Bank Transfer, Bank Deposit, Gcash transactions and Money Centers.
   3. Data Storage: Our website, mobile application, and web application store the personal data gathered upon enrollment. However, the banks that will transact the payments will never store credit/debit card information, card validation code, or PIN block data. Storage of such data is prohibited by the PCI DSS (Payment Card Industry, Data Security Standard).
   4. Security: Our website, mobile application, and web application use up-to-date and reliable technologies and procedures to help protect personal information from unauthorized access, use, or disclosure.
4. Section 4. Programs and Expectations

   By enrolling in MetamoRPh Review Specialist, Inc., the enrollee acknowledges that the details of all available programs, including their respective coverage, structure, schedules, inclusions, and expectations, are made available through official MetamoRPh Review Specialist, Inc. information channels, including but not limited to its official website, webpages, and social media platforms.

   The enrollee is expected to review these program details through the provided links and official communications, where the complete description of each program and its corresponding expectations are outlined.

   By accessing, clicking, or continuing to use such links and platforms, the enrollee is deemed to have:

   • Reviewed and understood the specific features and requirements of the selected program;
   • Accepted the corresponding expectations, including participation requirements, timelines, and performance standards;
   • Agreed to comply with all program-specific guidelines, policies, and instructions issued by MetamoRPh Review Specialist, Inc..

   All such information, links, and communications shall form an integral part of these Terms and Conditions.

   Any details, conditions, or requirements not expressly included in the official informational channels shall be communicated by duly authorized MetamoRPh Review Specialist, Inc. personnel, and such communications shall likewise be considered binding and enforceable.

   Failure to review the program details and expectations shall not exempt the enrollee from compliance with the same.

5. Section 5. Account Use and Restrictions
   1. Access to services is subject to full payment without set-off or deduction of any kind.
   2. Cancellation

      MetamoRPh Review Specialist, Inc. reserves the right to cancel the subscription once any suspicious activity is detected. Suspicious activities may include but are not limited to:

      • Sharing of credentials (username and password) with other individuals, even if the third-party is another legitimate subscriber;
      • Unauthorized downloading of videos, notes, and lectures;
      • Unauthorized videotaping or photographing of any part of the web or mobile application;
      • Unauthorized sharing of videos, lectures, or notes outside the web application.
      • Unauthorized sharing of any content, infographics, announcements, list of students included in the group chats/discussions.
      • Presenting a false document (e.g., deposit slips, bank transfer confirmation, identification and others).
      • Posting or forwarding of fraudulent announcements and any form of slander against MetamoRPh Review Specialist, Inc.in any platform.
   3. Add-on Programs:

      A subscriber currently enrolled in Premium or Enhancement programs may have the option to add additional review programs such as the MetamoRPh Onsite Review and MetamoRPh Tutorials.

6. Section 6. Refund Policy
   1. Subscriptions cannot be cancelled once enrollment has been completed and a refund will not be provided to the subscriber.
   2. To ensure a slot, a minimum of Php 5,000 will be charged to the subscriber as a Reservation Fee. This amount will be deducted to the total review fee. The reservation fee or Php 5,000 or higher is non-refundable.
   3. Prior to the start of the batch, a confirmation message will be sent to the subscriber. Failure to respond to the confirmation message and paying the full amount a day before the chosen batch starts will result to the invalidation of slots and forfeiture of the enrollee's reservation fee.
   4. Cancelled subscriptions due to any of the violations listed in the terms and conditions will not entitle the subscriber to any form of refund; moreover, the party found in violation will face charges in accordance with applicable intellectual property laws of the Philippines
7. Section 7. Force Majeure

   MetamoRPh Review Specialist, Inc. shall not be liable for any delay, interruption, suspension, or failure in the performance of its obligations under these Terms and Conditions where such delay or failure is caused by events beyond its reasonable control ("Force Majeure Event").

   Force Majeure Events shall include, but are not limited to:

   • Acts of God, including earthquakes, typhoons, floods, fires, volcanic eruptions, and other natural disasters;
   • Public health emergencies, including pandemics, epidemics, or outbreaks of infectious diseases;
   • Government actions, orders, regulations, or restrictions, including lockdowns, quarantine measures, or suspension of classes;
   • War, civil unrest, rebellion, terrorism, or other similar disturbances;
   • Power interruptions, internet outages, system failures, or disruptions in telecommunications or digital infrastructure;
   • Cybersecurity incidents, including hacking, data breaches, or malicious attacks affecting system operations;
   • Any other event or circumstance beyond the reasonable control of MetamoRPh Review Specialist, Inc..

   In the occurrence of a Force Majeure Event, MetamoRPh Review Specialist, Inc. shall have the right, at its sole discretion, to:

   • Suspend, reschedule, or modify any program, service, or activity;
   • Change the mode of delivery (e.g., from onsite to online or vice versa);
   • Extend access periods or adjust timelines as may be reasonably necessary;
   • Implement alternative arrangements to ensure continuity of services where feasible.

   The occurrence of a Force Majeure Event shall not constitute a breach of contract, and MetamoRPh Review Specialist, Inc. shall not be held liable for any damages, losses, or inconvenience arising therefrom.

   Unless otherwise required by applicable law, no refunds, reimbursements, or compensation shall be due to the enrollee as a result of delays or changes caused by a Force Majeure Event.

   MetamoRPh Review Specialist, Inc. shall exert reasonable efforts to notify affected enrollees and resume normal operations as soon as practicable under the circumstances.

8. Section 8. Non-Transferability and Non-Sale of Account and Materials

   All enrollments, subscriptions, and accounts under MetamoRPh Review Specialist, Inc. are strictly personal, non-transferable, and for the exclusive use of the registered enrollee.

   The enrollee expressly agrees that he/she shall not:

   • Sell, assign, sublicense, lease, or otherwise transfer access to any program, account, or subscription to any third party;
   • Share login credentials (including username, password, or access codes) with any other individual, whether or not such individual is also enrolled in any MetamoRPh Review Specialist, Inc. program;
   • Allow simultaneous or unauthorized access to the account from multiple users or devices in a manner inconsistent with normal personal use;
   • Use another person's account or allow another person to use his/her account for any purpose;
   • Circumvent, disable, or interfere with any security or access control measures implemented by MetamoRPh Review Specialist, Inc.;

   In addition, all review materials—whether digital or physical—are strictly for the personal use of the enrollee and shall not be sold, reproduced, distributed, or transferred in any form, or used for commercial, instructional, or competitive purposes. This includes, but is not limited to:

   • Online video lectures, notes, quizzes, and examination content;
   • Downloadable or printable materials;
   • Hard copy manuals, including but not limited to the Bluebook and Pharmacy Essentials: Practice Exams;

   Any form of resale, redistribution, or commercial use of MetamoRPh Review Specialist, Inc. materials, whether in whole or in part, is strictly prohibited.

   MetamoRPh Review Specialist, Inc. reserves the right, at its sole discretion, to:

   • Monitor account and material usage;
   • Suspend, restrict, or permanently terminate access to any account found in violation;
   • Confiscate or invalidate access to materials obtained or used in violation of this provision;
   • Deny access to all services without refund;
   • Pursue appropriate legal action for damages and/or violations of intellectual property laws.

   Any violation of this Section shall be considered a material breach of these Terms and Conditions.

   The enrollee may also be held liable for liquidated damages equivalent to not less than the full program fee, without prejudice to other legal remedies.

   MetamoRPh Review Specialist, Inc. reserves the right to deny future enrollment of any service to any individual found in violation of these Terms and Conditions

9. Section 9. Academic Integrity

   MetamoRPh Review Specialist, Inc. upholds strict standards of academic integrity in all review activities, including quizzes and mock board examinations.

   The following are strictly prohibited:

   • Cheating or any form of academic dishonesty;
   • Unauthorized collaboration or communication during examinations;
   • Use of unauthorized materials or devices;
   • Recording, copying, or sharing examination content;
   • Impersonation or allowing another person to take examinations on one's behalf.

   MetamoRPh Review Specialist, Inc. reserves the right to monitor activities and investigate any suspected violations.

   Any violation shall result in:

   • Disqualification from the examination;
   • Invalidation of results;
   • Suspension or termination of access without refund;
   • Possible legal action and/or reporting to affiliated institutions.

   All violations shall be considered a material breach of these Terms and Conditions.

10. Section 10. Data Privacy

    Personal data of enrollees shall be collected, processed, and protected in accordance with the Data Privacy Act of 2012 and other applicable laws.

    By enrolling, the student authorizes MetamoRPh Review Specialist, Inc. to collect, use, and process personal information, including but not limited to academic records, examination results, performance data, and related information, for academic, administrative, and legitimate business purposes.

    The student further authorizes MetamoRPh Review Specialist, Inc. to share relevant information, including but not limited to examination performance and academic standing, with potential employers, partner institutions, or affiliated organizations for purposes of employment facilitation, recommendation, or professional advancement.

    If the student does not consent to the sharing of such information, he/she must formally notify MetamoRPh Review Specialist, Inc. through its official email (metamorph.admn@gmail.com) prior to or during enrollment. In the absence of such notice, consent shall be deemed expressly granted.

    Such authorization shall remain valid unless revoked in writing by the student, subject to applicable laws and existing data already processed.

    MetamoRPh Review Specialist, Inc. ensures that all data processing is conducted with appropriate safeguards to maintain confidentiality, integrity, and security of personal information.

11. Section 11. Limitation of Liability

    To the fullest extent permitted by law, MetamoRPh Review Specialist, Inc. shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, including but not limited to loss of data, loss of opportunity, loss of profits, or any similar damages arising from or in connection with the use of its services.

    In all cases, the total liability of MetamoRPh Review Specialist, Inc., if any, shall be limited to the amount actually paid by the enrollee for the specific program or service.

    MetamoRPh Review Specialist, Inc. shall not be liable for any actions, omissions, or service interruptions caused by third-party providers, including but not limited to payment platforms, hosting services, or communication platforms.

12. Section 12. Dispute Resolution

    These Terms and Conditions shall be governed by and construed in accordance with the laws of the Philippines.

    Any dispute, controversy, or claim arising out of or in connection with these Terms and Conditions shall be resolved exclusively by the competent courts of the Philippines, unless otherwise agreed upon in writing by the parties.

13. Section 13. No Waiver

    Failure of MetamoRPh Review Specialist, Inc. to enforce any provision of these Terms and Conditions shall not be construed as a waiver of any rights or remedies.

14. Section 14. Severability

    If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Section 15. Entire Agreement

    These Terms and Conditions constitute the entire agreement between the parties and supersede all prior agreements, communications, or understandings.
